Legionella Risk Assessment
It is a requirement under Control of Substances Hazardous to Health Regulations 2002 (COSHH) to assess the risk from biological hazards which include potentially deadly Legionella bacteria. This requirement is enforced by HSE ACoP L8: The Control of Legionella Bacteria in Water Systems. The first step in compliance will be the undertaking of a Legionella Risk Assessment.
Employers have a duty of care and a legal obligation to undertake a Legionella Risk Assessment on all premises where there is a foreseeable risk of exposure to Legionella bacteria. This includes:
- All hot and cold water systems;
- Water systems incorporating cooling towers;
- Water systems incorporating an evaporative condenser;
- Containing water systems.
As an employer or a person in control of the premises (e.g. a Landlord), you must:
- Undertake a Legionella Risk Assessment;
- Identify and assess sources of Legionella bacteria risk;
- Prepare a scheme, (or course of action), for preventing or controlling the risk of Legionella within your premises;
- Implement and manage the Legionella control policy;
- Appoint a person to be responsible for your Legionella testing, design and management of your action or management plan;
- Keep records and check that precautionary systems are effective, (continued Legionella monitoring);
- If appropriate, notify the local authority that you have a cooling tower(s) on site;
- Review your Legionella Risk Assessment periodically.
